Please read these Terms of Service (“Terms”) carefully before using the GPS tracking devices, software, website, mobile applications, or related services provided by TrackMI GPS Tracking Solutions (“TrackMI,” “we,” “us,” or “our”). By accessing or using our Services, you agree to be bound by these Terms.

If you do not agree, do not use the Services.

1. Definitions

  • “Services”: All GPS tracking devices, platforms, data portals, applications, websites, and support provided by TrackMI.
  • “User,” “You,” “Customer”: Any individual or entity that purchases, uses, accesses, or manages the Services.
  • “Device”: Any GPS tracker, SIM, accessory, or hardware supplied by TrackMI.

2. Eligibility

You must be:

  • At least 18 years old or legally able to enter into contracts.
  • Authorized to act on behalf of the entity using the Services (if applicable).

You agree not to use the Services for unlawful purposes.

3. Lawful Use of GPS Tracking

By using TrackMI devices and services, you acknowledge:

  1. GPS tracking may be regulated by federal, state, or local laws.
  2. You are solely responsible for ensuring your use complies with all applicable privacy, employment, and surveillance laws.
  3. TrackMI does not provide legal advice regarding the legality of tracking activities.
  4. Misuse of GPS tracking equipment may result in civil or criminal penalties.

You assume full responsibility for obtaining consent when required by law.

4. User Responsibilities

You agree to:

  • Use the Services only for lawful and authorized purposes.
  • Maintain the confidentiality of your login credentials.
  • Ensure no unauthorized individuals access your account.
  • Not interfere with system integrity, security features, or network resources.
  • Not resell, redistribute, or repurpose the Services without written consent.

You are responsible for all activity that occurs under your account.

5. Service Availability & Accuracy

  • GPS data depends on satellite, cellular, and third-party infrastructure.
  • Service interruptions may occur due to coverage gaps, hardware issues, environmental conditions, or network outages.
  • While TrackMI strives for reliable service, we do not guarantee 100% uptime or perfect accuracy of location data.

6. Fees, Billing & Payments

  • Fees (monthly plans, device purchases, activation fees, etc.) are stated at the time of purchase or on your service agreement.
  • Payments are due based on your plan terms, usually on the 25th of the month.
  • Unpaid balances may result in device deactivation or account suspension.
  • All fees are non-refundable unless otherwise required by law.

Chargebacks or fraudulent disputes may result in account termination.

7. Subscription Terms & Auto-Renewal

If you enroll in a subscription or monthly plan:

  • Plans renew automatically unless canceled prior to the renewal date.
  • You authorize TrackMI to charge the payment method on file.
  • To cancel, you must submit notice through our support channel or account portal.

You remain responsible for charges incurred prior to cancellation.

8. Device Ownership & Returns

Unless otherwise specified:

  • Purchased devices become your property.
  • Rented or leased devices remain TrackMI property and must be returned in working condition.
  • Damage, loss, or failure to return leased devices may result in replacement fees.

Warranty details are provided separately or with device documentation.

9. Data Ownership & Privacy

  • You retain ownership of the GPS data produced by your devices.
  • TrackMI processes, stores, and transmits data only for the purpose of providing the Services.
  • Our use, storage, disclosure, and retention of information is governed by our Privacy Policy.
  • TrackMI does not sell user data to third parties.

10. Prohibited Uses

You may not use the Services to:

  • Track individuals without proper legal authority or consent
  • Stalk, harass, or harm any person
  • Monitor employees without adhering to employment and privacy laws
  • Violate criminal or civil surveillance statutes
  • Tamper with or misuse hardware or software

Any violation may result in immediate termination and potential law enforcement reporting.

11. Intellectual Property

All software, tools, website content, logos, and materials are the property of TrackMI or licensed to us. You may not:

  • Copy
  • Modify
  • Reverse engineer
  • Reproduce
  • Distribute

any part of our proprietary platform without written permission.

12. Support & Maintenance

Support is provided through:

  • Email
  • Text messaging
  • Phone

We may periodically update the software or systems with or without notice.

13. Limitation of Liability

To the fullest extent permitted by law:

  • TrackMI is not liable for damages caused by misuse, illegal tracking, loss of data, service outages, or reliance on GPS information.
  • We are not responsible for indirect, incidental, punitive, or consequential damages.
  • Your sole remedy for dissatisfaction with the Services is to discontinue use.

14. Indemnification

You agree to indemnify, defend, and hold harmless TrackMI and its affiliates from any claims, damages, liabilities, or expenses arising from:

  • Your use of the Services
  • Violation of laws regarding tracking
  • Breach of these Terms
  • Misuse of devices or data

15. Termination

We may suspend or terminate your access to the Services if:

  • You violate these Terms
  • Payments are not received
  • Illegal use is detected
  • Fraudulent activity is suspected

Upon termination, access to your account and historical data may be revoked.

16. Governing Law

These Terms are governed by the laws of the state of [Insert State], without regard to conflict-of-law principles.
Disputes shall be resolved in the appropriate courts of that state.

17. Changes to Terms

We may update or modify these Terms at any time. Updated terms will be posted with a revised “Last Updated” date.
